I don't know about Britain, but in the US it's common for the defense lawyers and prosecutors to hammer out a plea deal, wherein the defendant agrees to plead Guilty or No Contest to a lesser charge in order to avoid a trial. That being said, the deal is not usually $$$ in exchange for avoidance of prosecution, although the lesser charge might involve only a fine and probation, rather than prison time.

Needless to say, these agreements need to be in writing, preferably with the assistance of one's attorney. I recently saw an episode of the TV show 20/20, which was similar to the murder case by the Spaniard from the other string. The cops told the murderer than they 'might" show leniency at trial if the killer would lead them to the bodies. When the trial came, however, the murderer received the death sentence (in Texas, where those sentences are often carried out). Fortunately, murderers are often also quite stupid. I'm not sure why that stupid Spaniard led the cops to the places where he discarded the body parts. He did not seem to get any leniency in return, and apparently could be eligible for the death penalty. Leading cops to body parts obviously removes any possible doubt one did the deed.

those are two out of 202 jurisdictions in the world and fundamental  differences between them exist.

From our own backyard - you may have sex with your boyfriend in Los Angeles and it's just sex. Do the same in Kampala or Riyad and you may be dangling from the gallows.

I think that this comes down to semantics to some degree.  Settling a case usually involves a cash settlement.  Done commonly in civil cases.

Taking a plea bargain involves a criminal defendant accepting usually a lower sentence and/or charge from the prosecutor.  Defendants can offer prosecutors something in exchange for the reduced sentence (testify against someone else, location of victims, body parts, money, etc).

But if a criminal defendant offers a cash settlement to a prosecutor, he is likely to face additional charges.  Unless…he gets lucky with the prosecutor.

In some systems (France and Germany for example), the victim or the victim’s family can be represented in court as civil parties by their own counsel during the criminal trial. 

This Swiss guy or his family (probably not the wife since she already ran away) may want to get him out of the criminal case.  The alleged bribe is vague and unlikely to become part of the case, unless they can nail down the details enough to arrest the people making the bribe.  But bribes are offered for criminal cases, not lawsuits.  

In many jurisdictions, if a living victim refuses to press charges, there is not case.   Possibly the goal here.

The Phuket Court on Tuesday acquitted a Swiss national of a charge that he kicked a female Thai doctor who was sitting on a beach in front of a luxury villa he had rented in Thalang district in February.

The court reasoned that public prosecutors and a co-plaintiff, Dr Thandao Chandam, failed to prove beyond doubt that the Swiss man, Urs “David” Fehr, had intentionally kicked the doctor in the back as charged.

As a result, the court said Fehr was acquitted on the benefit of doubt. Earlier, Thandao, 26, a doctor at Dibuk Hospital in Phuket, told media that she had been kicked in the back on the night of February 24 by Fehr while sitting on steps at Yamu Beach in front of a villa in Thalang district.

Thandao said she felt the need to go public and expose the alleged assault because during the incident Fehr’s Thai wife had claimed a strong connection with senior Phuket police officers.

Judging by the report in yesterday's NationThailand taken from the court transcript, CCTV footage showed there wasn't a kicking, also the Dr. was on the 2nd step up from the beach, so not physically possible if 'David' was on the top step. Also the Dr.'s witness who provided a statement was different from the Dr.'s statement, so no collaboration. Plus the Police report hi-lited if the man did kick the Dr., she would have landed on the beach, as opposed to standing up and walking away from where she was sitting as shown on the CCTV footage. Also the bruise on the Dr. 's back submitted as evidence was never medically verified, so dismissed in court.

Just goes to prove the total inaccuracies people believe in from Social Media, although antisocial media is more apt an expression.

Wow. This is completely opposite of the media news report, which stated that there was a video documenting the alleged battery. Thanks for correcting the misinformation. But why wait for the facts to come out when it's so easy to accuse and hold a rally? This certainly isn't the first time @reader has passed along inflammatory and/or misleading (and, in this instance, categorically false) reports from the Thai press.

To be fair in @reader's defence, the more sensational story of a burly Swiss farang doing an Eric Cantona Kung Fu kick (Jan 1995) creates more column inches than what came out in this weeks court case. The tragedy of the event, is despite what we all believed at the time from the initial social media posting picked up by the local and then the national press, Farangs behaving badly and all that, that's the story the vast majority of people will always remember. Not the fact the alleged victim over fabricated the event.

Well, obviously, I agree that one can create a lot of interest with sensational lies. The problem with people who spread lies is that eventually others won't trust a word those people say.

A doctor who claimed to have been kicked by a Swiss man while she was sitting on the steps near his property on Yamu Beach in February has vowed to appeal his acquittal on assault charges.

Dr Thandao Chandam, 26, said on Thursday that she was disappointed by the court’s decision.

Thanking the public for the moral support she received during the case, she said she would continue to fight for justice, adding that she stood by her accusation of assault.

Her father, Kasem Chandam, said the family decided to appeal for the sake of fairness, adding that he hoped the public would keep up with the support. “We will do our best to regain justice,” he said.

Dude, from @BjornAgain's report, CCTV footage clearly proved her accusation was bogus, and you're doubling down on the lie? Of course, one should not have to prove one's innocence. It should be up to the accuser to prove the crime. However, in this instance, not only was the accusation not sustained, but it was completely disproven. They apparently weren't even in close proximity. Simply repeating verifiably false accusations is beyond disgusting. Shame on you and the Bangkok Post. Everyone can see with their own eyes what a bullshitter you are. Another instance of mob mentality oblivious to the actual facts. If anything, the Swiss man should sue her for fraud, and she should be prosecuted for filing a false police report.

Fortunately for the Swiss man, the interaction was videotaped, and it's now known that the doctor is the liar. You and the BP are continuing to try to fan the public flames, instead of admitting "Oops. We goofed. It turns out she was lying." You're as disgusting as Trump, who states stuff like "I've heard Harris is a child molester. It's just what I've heard...", when he know what he's saying is complete BS. And you're both like George Santos who, when caught lying, doubles down with another lie. The proper thing to do would be to admit that you were duped. Being duped can happen. Lying is intentional.
