We learn that 26-year old James Rackover is the prime suspect. Then we learn that Rackover has a sugar daddy who gave his name to James and tried to help cover up the murder. Rackover allegedly confessed to the murder. His sugar daddy is the "jeweler to the stars" Jeffrey Rackover., who provides James with his own apartment in the same building. James reportedly blamed "roid-rage" as the cause of the murder. There are two other suspects/witnesses, both macho handsome guys. Yet nowhere in this story is the word "gay" used. Victim Joseph Comunale, 26, was already beaten unconscious and bleeding profusely when Rackover wrapped the denim around his neck on Nov. 13, according to the shocking new documents made public Wednesday. The scenario was laid out for the first time as lawyers for three people allegedly inside the luxury apartment-turned-murder scene sought separate trials in the heinous murder. The chilling story, offered by an attorney for witness Max Gemma, offers gruesome new details in the savage killing of Comunale inside Rackover's E. 59th St. apartment. Jeweler to stars helped surrogate son Rackover conceal body: suit Rackover, 26, the court papers reveal, flew into a maniacal and murderous rage in the midst of a fistfight between Comunale and co-defendant Larry Dilione, 28. Rackover “punched and kicked in (Comunale) the head and face several times, and smashed the back of his head into the hard wood floor several times,” charged a Manhattan Supreme Court filing by Gemma's attorney Mark Bederow. “Rackover's attack left Comunale bleeding profusely and created a bloody mess in the living room floor,” the court filing continued. “Rackover panicked about returning to prison. He ordered Gemma and Dilione to take off their clothes." When the two stripped down, Rackover straddled Comunale while wrapping Dilione’s jeans tightly around his hands “as if he were preparing to choke Communale,” the papers concluded. DA tosses suspect James Rackover's gripe at murder trial Authorities believe the victim’s cause of death was stabbing rather than strangling. His death seems the result of a stupid prank that he and his girl friend wanted to stage for youtube. Ruiz, 22, was the father of one and his girl friend is pregnant with the second child.
