Scalia’s Latest Outburst

An impartial observer, one just calling balls and strikes, might deem Justice Antonin Scalia a fair-weather fan of judicial restraint. On June 25, he helped strike down section 4 of the Voting Rights Act. On June 26, he railed against the majority’s decision to strike down section 3 of DOMA, arguing that the Supreme Court has “no power under the Constitution to invalidate this democratically adopted legislation.”

But in theory, at least, he’s vehemently opposed to judicial activism.

Via Talking Points Memo, Justice Scalia brought Godwin’s Law to Snowmass, suggesting in an address to the Utah State Bar Association that activist judges helped bring about the Holocaust.

According to The Aspen Times:

Scalia opened his talk with a reference to the Holocaust, which happened to occur in a society that was, at the time, “the most advanced country in the world.” One of the many mistakes that Germany made in the 1930s was that judges began to interpret the law in ways that reflected “the spirit of the age.” When judges accept this sort of moral authority, as Scalia claims they’re doing now in the U.S., they get themselves and society into trouble.

The title of Justice Scalia’s talk was “Mullahs of the West: Judges as Moral Arbiters.”

A shame that the terrible trio of Scalia, Thomas and Alito cannot be permanently sent out to pasture. For sure Scalia has sprung a gasket, Thomas never had a gasket to be sprung and Alito is not even open to having his gasket sprung.
