Guest EXPAT Posted February 3, 2012 Posted February 3, 2012 With the courts becoming ideologically driven instead of legally driven, one wonders what will happen when they review the Affordable Care Act. There are some hints based on past cases and the fact that Chief Justice John Roberts doesn't want to draw bad criticism to the court. http://www.huffingtonpost.com/2012/02/03/supreme-court-health-reform_n_1251156.html?ncid=edlinkusaolp00000009 Quote
Members JKane Posted February 3, 2012 Members Posted February 3, 2012 Was just reading something about how Stephan Colbert's PAC is doing a great job embarrassing them and drawing attention to the politicization that drove the Citizens United travesty. Quote
Guest BewareofNick Posted February 5, 2012 Posted February 5, 2012 I think it all comes down to Kennedy. Roberts, Scalia, Alito and Thomas obviously will vote against it. Ginsberg, Sotomayor and Breyer will vote for it. Kagan may have to recuse herself. Kennedy will likely be the deciding vote. If Kagan recuses herself, the vote will likely be a tie. If she does not, it wins. Quote
